Acceptance of Terms
By downloading, installing, accessing, or using the Black Card Verified mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
Description of Service
Black Card Verified is a culturally-focused trivia game designed to celebrate and test knowledge of Black culture. The App offers:
- Nine distinct trivia categories including Black Twitter, Music, Movies & TV, Black History, HBCUs, Black Church, Old School, Girls Night, and West African Culture.
- AI-generated questions powered by advanced language models.
- Solo and multiplayer gameplay modes.
- Ice Breakers party game features.
- Global leaderboards and statistics tracking.
- Premium subscription services.
User Accounts
To access certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Immediately notify us if you discover or otherwise suspect any security breaches related to the App.
You may register using email and password, phone number with OTP verification, Google OAuth, or Apple Sign-In (on iOS devices).
Free Tier
Free-tier users have access to:
- Up to three (3) games per day.
- Limited category access.
- Advertisement-supported experience.
Premium Subscription
Premium subscribers ($2.99/month or $29/year) receive:
- Unlimited daily games.
- Ad-free experience.
- Access to all categories.
- Exclusive content.
- Priority access to fresh AI-generated questions.
Premium subscriptions are managed through RevenueCat and processed via the Apple App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage your subscription through your Apple ID account settings.
User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App.
- Use any robot, spider, scraper, or other automated means to access the App.
- Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful.
- Interfere with or disrupt the App or servers or networks connected to the App.
- Harass, abuse, or harm other users.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Cheat or manipulate game scores, leaderboards, or statistics.
Multiplayer and Social Features
When using multiplayer modes or Ice Breakers features, you agree to conduct yourself appropriately and respectfully toward other users. We reserve the right to suspend or terminate accounts that violate community standards.
Room codes and game sessions are temporary and may expire. We are not responsible for any data loss related to multiplayer sessions.
Intellectual Property
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Black Card Verified, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
"Black Card Verified," the Black Card Verified logo, and "Get Verified" are trademarks of Black Card Verified. You may not use these marks without our prior written permission.
AI-Generated Content
Questions and content within the App may be generated using artificial intelligence. While we strive for accuracy, we do not guarantee the accuracy, completeness, or reliability of AI-generated content. Such content is provided for entertainment purposes only.
Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER BLACK CARD VERIFIED NOR ANY PERSON ASSOCIATED WITH BLACK CARD VERIFIED MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP.
Limitation of Liability
IN NO EVENT WILL BLACK CARD VERIFIED, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE APP OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Indemnification
You agree to defend, indemnify, and hold harmless Black Card Verified, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the App shall be instituted exclusively in the federal courts of the United States or the courts of the State in which Black Card Verified is headquartered.
Arbitration
At the Company's sole discretion, it may require you to submit any disputes arising from these Terms or use of the App, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association.
Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.
